Office of the County Attorney

The Office of the County Attorney is created pursuant to the Office of the County Attorney Act, 2020.  The Office of the County attorney is recognized as a unit of governance and as a standalone department in the County Government.

Its fundamental duties including but not limited to negotiation, drafting, vetting, review & interpretation of documents, Litigation Management, review of County legislation and Advisory to the departments in tandem with the Law to the Executive.

Section 7 Office of the County Attorney Act, 2020 outlines the functions of the County Attorney, as follows:

Giving legal advice to the county government

Representing the county executive in court or in any other legal proceedings to which the county executive is a party, other than criminal proceedings;

Advising departments in the county executive on legislative and other legal matters

Negotiating, drafting, vetting, and interpreting documents and agreements for and on behalf of the county executive and its agencies;

Revising county laws, among other functions

Appearing at any stage of any proceedings, appeal, execution, or any incidental proceedings before any court or tribunal in which by law the County Attorney’s right of audience is not excluded

Requiring any officer in the county public service to furnish any information in relation to any matter which is the subject of a legal inquiry

Summoning any officer in the county public service to explain any matter which is the subject of litigation by or against the county executive

Issuing directions to any officer performing legal functions in any department within the county executive
